The right question is not only “Can I buy?” but “What exactly am I buying?”
Most Los Cabos purchases can be evaluated through a familiar sequence—define the property, review ownership and title evidence, inspect condition, understand contracts and costs, and close through the appropriate Mexican professionals.

Los Cabos lies within Mexico’s constitutional restricted zone. Foreign buyers commonly acquire beneficial rights through a bank trust, or fideicomiso, rather than taking title in the same form used by a Mexican citizen.
The trustee holds legal title under the trust, while the beneficiary exercises rights defined by Mexican law and the trust documents. The property is not simply leased from the bank, and it should not be treated as a bank asset.
Confirm the legal description, title history, trust permit and agreement, liens, beneficiary instructions, term, fees, access, services, federal-zone relationships where relevant, and any condominium or association regime.

A fideicomiso can allow the beneficiary to use, improve, rent, transfer, or sell the property, subject to the executed documents and applicable law. Instructions to the trustee and the steps required for a transfer should be understood before signing.
Trusts have defined terms and renewal procedures. Confirm the remaining term and all current bank, permit, amendment, cancellation, assignment, and renewal requirements for the exact file.
Substitute beneficiaries can be named, making the trust relevant to estate planning. Coordinate those designations with qualified Mexican counsel and any cross-border estate plan.

Request a written closing estimate for the exact property. Trust work, notary and registry charges, acquisition taxes, certificates, due diligence, escrow, legal work, and other amounts vary with the transaction.
Inspect the physical property and review permits, plans, warranties, maintenance records, utilities, drainage, waterproofing, corrosion exposure, insurance, furnishings, and deferred work.
For condominium, resort, or master-planned property, review the governing regime, budgets, reserves, insurance, rules, assessments, services, rental restrictions, club rights, and transferability of every represented benefit.

A licensed local real-estate professional can help organize the search and transaction, but buyers should also identify the independent professionals needed for legal, tax, inspection, engineering, escrow, currency, and closing questions.
Before closing, reconcile the executed contract, title or trust documents, property description, inventory, condition, funds, currency, closing statement, releases, association standing, utilities, possession, keys, and post-closing filing or administration steps.
This guide preserves the useful ownership subjects from the source page while replacing dated assurances with current-document review.
